Vijil did not have legal representation this morning.
Officers for the Farmington Police Department were dispatched around 3:08 a.m. Saturday to the 900 block of Fairgrounds Road on reports of a sexual assault, according to the probable cause statement.
Vijil was identified as the suspect, and he later was found in a minivan at a nearby residence.
An officer stayed with Vijil as another officer went into the residence to speak to the alleged victim. The victim told the officer she had been drinking with some people, including Vijil earlier in the evening, and she went to her room around 11 p.m.
The victim stated she was awakened when she felt her face being pushed down onto the mattress. Vijil allegedly held the victim down on the mattress and sexually assaulted her, according to court documents.
The victim told police when she was able to force herself off the bed, she heard a noise and allegedly saw Vijil on the bedroom floor.
The victim added she ran to another room in the residence, telling a female witness that Vijil was "on top of me" and that he possibly had molested her, according to the probable cause statement.
A detective arrived at the scene and interviewed Vijil before the suspect was arrested. Vijil's interview was not included in the probable cause statement.
Vijil had his first appearance Monday morning in Farmington Magistrate Court.
He was being held at the San Juan County Adult Detention Center on a no-bond hold this morning.
Vijil's preliminary hearing in Farmington Magistrate Court is scheduled for the morning of Oct. 10.
