Incident alleged to have taken place at house party

FARMINGTON — An Aztec man who once served as a San Juan County sheriff's deputy is accused of sexually assaulting a woman during a house party early Tuesday.

Daniel Chesser, 30, is accused of two second-degree felony counts of criminal sexual penetration and a misdemeanor count of criminal sexual contact, according to the criminal complaint.

He is accused of forcing a woman to perform oral sex on him, forcing her to participate in anal intercourse and groping her bare breast, according to the arrest warrant affidavit.

Steve Murphy, Chesser's attorney, said the alleged victim, her husband, Chesser and his girlfriend were involved in a group sexual activity, or "swinging," when the victim "jumped the gun" and made her husband very jealous.

Murphy said the alleged incident was a misunderstanding, and the victim didn't want to hurt her husband's feelings.

The San Juan County Sheriff's Office posted an entry on its Facebook page about the arrest and stated that Chesser was a deputy from March 24, 2014, to April 15, 2016. Sheriff's Office spokesperson Jayme Harcrow said Chesser voluntarily left the agency.

Deputies were dispatched around 2:39 a.m. Tuesday to a residence on County Road 3010 southwest of Aztec on a report of a possible rape.

The alleged victim and her husband were interviewed separately at the Sheriff's Office.

The alleged victim told police the couples were spending the evening together at the residence with their children and were drinking alcohol, and their consumption increased after the children went to bed.

She added the couples talked individually about sexual activity but did not discuss it as a group.

The suspect allegedly made very strong sexual approaches to the victim in the kitchen that night while his girlfriend and the victim's husband were outside, according to the arrest warrant affidavit.

The victim told police Chesser pulled down her pants multiple times and pulled down her shirt, touching her bare breast with his hand.

Chesser allegedly forced the victim to perform oral sex on him, then allegedly forced the woman over the kitchen counter and raped her, according to the affidavit.

The victim said she immediately told her husband about the alleged incident after it occurred.

The husband armed himself with a knife and handgun, ordering the other couple and children to leave.

The husband told police the couple and the children got into a truck, and as they were leaving, he slammed the knife into the hood of the truck.

Chesser was interviewed at the Sheriff's Office after he was located at his Aztec residence.

He initially denied all sexual activity to the detectives, and he claimed the couples had been talking about group sexual activity all night, according to the affidavit.

Chesser later stated the victim came on to him and that he touched her bare breast.

When asked a second time by detectives where he touched the victim, Chesser changed his story and stated the victim "accidentally" fell on him and that they had kissed earlier in the evening, records state.

Chesser made his first appearance this morning in Aztec Magistrate Court. His preliminary hearing is scheduled for the morning of July 26.

He was booked into the San Juan County Adult Detention Center and released following a court order.
