Suspect looks forward to proving her innocence in court

FARMINGTON — A San Juan County woman is accused of sexually assaulting a juvenile male during an incident that allegedly occurred more than two years ago.

Traci Bergin, 26, is accused of a first-degree felony count of criminal sexual penetration of a child under 13, and a second-degree felony count of criminal sexual contact with child under 13, according to court documents.

Arlon Stoker, Bergin's attorney, said his client looks forward to proving her innocence in court. He added Bergin plans to be booked into the San Juan County Adult Detention Center and released.

The San Juan County Sheriff's Office handled the investigation.

A detective was present during a June 19 safe house interview conducted with the alleged victim along with a relative with guardianship of the male, and that relative's girlfriend.

Bergin is accused of using a "vibrating apparatus" on the naked genital area of the juvenile male and anally penetrating him "to the slightest degree" sometime between April 1 and May 30, 2016, according to the arrest warrant affidavit.

The girlfriend stated the victim told them about the alleged incident in 2016 and that she had recorded a video of him making the statement, according to court documents.

The victim said Bergin was on drugs when she would get a "vibrating thing" and touch him with it. He added she barely inserted the item into his anus.

A review of medical records showed the alleged incident was disclosed to the victim's doctor on June 23, 2016, while the doctor was examining the child for an ear ache, according to court documents.

Detectives spoke to Bergin along with a relative on June 27.

Bergin initially stated she was not aware of the allegations, then stated a relative told her that she "that something happened that she shouldn't have done," according to the affidavit.

She denied the allegations when brought up by the detectives, adding she had never done anything to the victim.

Stoker filed an entry of appearance and a motion to waiver the rights of Bergin's first appearance Friday in Aztec Magistrate Court.

Her next court hearing was not scheduled as of Monday afternoon.
