FARMINGTON — A San Juan County man is accused of raping a woman on the property of a Farmington motel.

Michael Harvey, 47, is accused of one third-degree felony count of criminal sexual penetration, according to court records.

Stephen Wayne, Harvey's public defender, could not be reached for comment today.

A Farmington Police Department officer was dispatched around 3:35 a.m. on June 10th to the Motel 6 at 1600 Bloomfield Blvd. on reports of woman sexually assaulted by a male, according to the arrest warrant affidavit.

The victim told the officer a male named Michael raped her and left the area.

She told the officer she was with a group of people, including Harvey and her fiancee, at the B Lounge bar at 600 E. Broadway Ave. earlier in the evening.

Harvey allegedly purchased the victim an alcoholic drink, and she stated she didn't remember much after that. The suspect allegedly told the victim he was going to "convert her to a heterosexual," according to court documents.

The victim stated she drank a lot while at the bar and remembered Harvey drove them back to the Motel 6.

The victim told police she remembered she went downstairs with Harvey at the motel to retrieve items from her vehicle.

She stated she later woke up in the bushes on the back side of the motel property while Harvey was raping her.

The victim's fiancee told police she searched for the victim for a couple of hours and when she returned to the motel, she spotted the victim and Harvey walking up the stairs.

Harvey then allegedly left the scene and headed eastbound.

Harvey waived his preliminary hearing Thursday in Farmington Magistrate Court and the case was bound over to district court.
