Two open cans of beer allegedly found in suspect's vehicle


FARMINGTON — A man is accused of his seventh DWI charge after allegedly driving his girlfriend and her two children while under the influence of alcohol.

Eric Trancosa, 37, is accused of third-degree felony counts of abuse of a child and aggravated driving while under the influence of liquor or drugs, according to court documents.

Trancosa is accused of consuming several cans of beer and driving his girlfriend and her two children from Nageezi to the carnival at McGee Park on May 19, according to the probable cause statement.

John Beckstead, listed as Trancosa's contracted public defender, could not be reached for comment today.

A deputy for the San Juan County Sheriff's Office was dispatched around 8:45 p.m. on May 19 to the parking lot at McGee Park at 41 Country Road 5568 on a report of a possible DWI investigation.

Trancosa allegedly smelled of a strong odor of beer and was wearing black sunglasses as he spoke to a deputy.

He told a deputy he had consumed several cans of beer but did not consume any alcohol since he arrived at the carnival.

While speaking to Trancosa, a deputy observed two open beer cans in the vehicle next to the driver's seat.

Trancosa claimed the cans were empty but the cans had several ounces of liquid inside when a deputy picked the cans up.

A deputy asked Trancosa if he would submit to a field sobriety test, and he agreed.

Trancosa's eyes were observed as "glassed over" and slightly red after he removed his sunglasses, according to court documents.

During the one-leg test, Trancosa allegedly lost his balance multiple times and used his arms to balance himself.

He was arrested for DWI and did not consent to a breathalyzer test at the San Juan County Adult Detention Center. A search warrant was obtained to get a sample of Trancosa's blood, according to court documents.

The San Juan County District Attorney's Office filed a motion to hold Trancosa without bond pending trial on May 21 in district court. District Judge John Dean Jr. ordered that Trancosa be held pending trial at the county jail during a May 24 hearing in Aztec District Court.

The motion cited Trancosa's six DWI convictions along with convictions including aggravated battery, aggravated fleeing a law enforcement officer and driving on a suspended license.

Trancosa's preliminary hearing is set for 10 a.m. Thursday in Aztec Magistrate Court.
