Derrick Mason arrested in connection with May 2 incident

FARMINGTON — A Fruitland man has been charged with aggravated burglary and criminal sexual penetration in the second degree after he allegedly broke into a home in Kirtland.

Derrick Mason, 22, also was charged with aggravated battery and false imprisonment from the May 2 incident, according to court records.

His public defender, Graham Gurnee, did not respond to requests for comment today.

Deputies from the San Juan County Sheriff's Office were dispatched at about 2:53 a.m. on May 2 to a residence on County Road 6674 on a report from a woman who woke up with an unknown man on top of her, according to the arrest warrant affidavit.

The victim told deputies she and her young son were sleeping in her bed when she felt pressure on her chest. When she woke up, she realized the pressure was not her son but an unknown man, who was holding down her arms and telling her to be quiet.

She said he fought with the man as he held down her, and he eventually relented and left the residence.

In an interview later, the victim said the man tried to remove her clothes, touched her breasts through her shirt and penetrated her vagina with his finger, according to the affidavit.

She told deputies that she kicked the man several times and demonstrated how he held her down by placing his hand on her face and neck.

She also followed the man as he walked out of the home and attempted to spray him with mace, the affidavit states.

Deputies found the man's phone, a makeshift pipe and a baseball cap inside the home, and several items were reported missing from the victim's vehicle parked at the residence, according to the affidavit.

Mason was arrested on May 3 after the Sheriff's Office requested the public's assistance in locating him in a post on the agency's Facebook page.

He remained in custody at the San Juan County Adult Detention Center today on a no-bond hold.

His preliminary hearing is set for 10 a.m. Thursday in Aztec Magistrate Court.

Mason was awaiting sentencing after pleading guilty to residential burglary in 2017 when he was arrested last week.
