Trial on hold for man accused of party stabbing
Shiprock resident Diego Mark pleaded not guilty to 2 counts of aggravated battery last year
FARMINGTON — Court proceedings for a Shiprock man accused of stabbing a man and causing a vehicle roll-over are on hold after a motion to determine if the suspect is competent to stand trial was approved.
Diego Mark, 19, was charged on April 10, 2016, in Aztec Magistrate Court with two counts of aggravated battery with a deadly weapon, a third-degree felony.
Mark is accused of stabbing a man in the abdomen outside a residence on County Road 6483 at a party following the Kirtland Central High School prom, according to The Daily Times archives.
Judge John Dean Jr. issued the order to suspend the proceeding to determine competency on April 10 following a motion by Mark's attorney, Adam Bell, filed on April 7, according to court records.
Bell's motion stated he believes Mark is not competent to stand trial and requested the stay for a trial scheduled on May 17-18, according to court documents and records.
Bell did not respond to requests from The Daily Times for comment.
The judge's order and Bell's motion did not include when or where Mark would be evaluated.
After the stabbing, Mark allegedly chased a female attending the party who then got in her vehicle and fled the party. Mark got in his pickup truck and followed the female until he allegedly rear-ended her vehicle near county roads 6487 and 6480, causing it to roll over.
She was treated for minor injuries to her right leg and face, according to court documents.
Mark was arrested by Navajo police officers later that morning after a brief chase but was released from custody before the San Juan County Sheriff's Office could issue an arrest warrant, according to The Daily Times archives.
He turned himself into the San Juan County Adult Detention Center on April 15, 2016, and pleaded not guilty on July 25 in district court, according to court documents.
