Man charged with fifth DWI, child abuse

FARMINGTON — A 32-year-old Shiprock man made an initial court appearance today after he was accused of drunken driving with his two children in the car.

Dennison Billy was charged Friday in Farmington Magistrate Court with his fifth drunken driving offense, child abuse and several traffic violations.

He has not yet retained legal representation, according to court records.

A deputy with the San Juan County Sheriff's Office stopped Billy's vehicle on Thursday afternoon at mile marker 41.5 on U.S. Highway 64, according to arrest records.

Billy was the operator of the vehicle, and a woman and Billy's two children were passengers, records state.

Billy told the deputy he had not consumed alcohol since the previous night, but the deputy noted Billy smelled like alcohol and had bloodshot eyes, according to records.

Billy agreed to perform a field sobriety test, which he failed, records state. He was placed under arrest and blew a 0.14/0.15 blood-alcohol content on a breath test, according to records.

The legal limit to operate a vehicle in New Mexico is 0.08 blood-alcohol content.

Billy's bond is set at $75,000.
