AZTEC – A 34-year-old father in Flora Vista was accused Tuesday of slapping and kicking his daughter, breaking her collarbone.

Brandon Rascon was charged Tuesday in Aztec Magistrate Court with child abuse causing great bodily harm, a first-degree felony punishable by up to 18 years in prison and $15,000 in fines.

Rascon has not yet retained legal representation, according to court records.

A deputy from the San Juan County Sheriff's Office were dispatched Sunday afternoon to the San Juan Regional Medical Center after receiving reports that a 15-year-old girl had been assaulted by her father, according to an arrest warrant affidavit.

The girl told the deputy she was at her home on County Road 3526 in Flora Vista earlier in the day when her father asked her to clean the house. She told him no, and her father slapped both of her legs, the affidavit states.

The girl told her father it did not hurt, and he then slapped her face and dragged her off her bed and onto the floor, according to the affidavit.

The girl told the deputy her father then kicked her in her left shoulder, which caused a sharp pain.

The girl's grandmother took her to the San Juan Regional Medical Center, where nurses reported her collarbone was bent, swollen and bruised, the affidavit states.

Rascon told the deputy he would not discuss the incident without an attorney present, according to the affidavit.

Rascon is expected to appear at a preliminary examination hearing on Dec. 3.
