Still no decision on Navajo Nation Council Speaker Johnny Naize's temporary restraining order request

FARMINGTON — Window Rock District Court Judge Carol Perry wants to know if Navajo Nation Council Speaker Johnny Naize was permitted to vote on the legislation that placed him on paid administrative leave.

In an order filed on Wednesday, Perry requests that attorneys from both sides discuss whether or not tribal law permitted Naize to vote on the legislation.

This is the latest development in the request for a temporary restraining order that Naize filed in April against council members who voted to place him on paid administrative leave after he was charged last year with bribery and conspiracy for allegedly misusing discretionary funds intended to help tribal members in need.

Both parties have until May 5 to submit briefs.

Last week, Perry listened to arguments from both sides during the hearing for Naize's request for a preliminary injunction.

At that time, she provided both parties the opportunity to resolve the issue using the Peacemaking Program, but no such request was submitted to the court.
