ALBUQUERQUE, N.M.—A woman convicted of careless driving has been sentenced to 90 days in jail after jurors rejected a vehicular homicide charge in a crash that killed an Albuquerque bicyclist.
Miranda Pacheco's first trial for the March 2010 crash that killed David Anderson resulted in a hung jury and mistrial. Her second trial ended last week.
Pacheco was 26 when she was charged in the crash and had faced 3 years in prison.
She claimed another driver cut her off, forcing her to swerve off the roadway and onto a bicycle path.
Prosecutors said she lost control while speeding and driving aggressively.
KRQE-TV reports ( http://bit.ly/PmdN1A) Pacheco sobbed through most of Tuesday's proceedings.
The sentencing included a song his wife Sherri selected for Miranda Pacheco to hear.
